        PTT Public Company Limited (hereinafter referred to as “PTT” or “we” or “our”) gives highest priority to the protection of the personal data of employees, employees on probation, former employees as well as the person in the family of the employees or the employees on probation, or the data of the other person that the employees or the employees on probation provided for us, and in order for you to ensure that we will protect and manage your personal data in accordance with the laws concerning personal data protection, we then established this Personal Data Privacy Notice for your acknowledgement of details of the processing of personal data, whether it be the collection, use and disclosure (collectively referred to as “the processing”) that may be occurred and including to inform you of the rights on your personal data and our contact channels as follows:


1.    Purposes for the collection, use and disclosure of personal data 

        As you are our employees on probation, employees or former employees, we shall collect, use and disclose your personal data by relying on relevant lawful basis for the following purposes:

For the proceedings in accordance with employment process, the performance of the employment agreement between you and PTT and other agreement in relation to employment such as non-disclosure agreement, policies and work rules, agreement for applying education scholarship for PTT employees, etc. including the amendment or supplement to such contract or agreement.

In this regard, the collection, use and disclosure of personal data for the purposes of this clause include the proceedings for:

    (1)  Communication with employees on probation and employees;

    (2)  Cooperation or the performing of duties or the entering into any transaction with customers, vendors, companies in PTT Group, government sectors, state enterprises, government authorities, public organizations, independent organizations established pursuant to the laws, authorities or any other third party, in the capacity of the representative of PTT, including the entering into agreement, the amendment to the relevant agreements or contracts, the granting or the obtaining of the delegation of authority as well as the providing of clarifications, data and statements to the third party or attending the trainings, seminars, academic seminars or lectures for third party on behalf of PTT;

    (3)  The management of relevant remunerations and welfare pursuant to the policies of PTT such as the preparation of payroll accounts, the management of relevant expenses, medical treatment, life insurance, the withholding and remittance of taxes, the providing of mental health consult and the proceedings in relation to loan agreement, etc.;

    (4)  Personnel management such as the appointment, position transfer, promotion, performance evaluation, competency evaluation and annual pay rise, including other personnel management according to the policies of PTT, etc. which shall mean to include the management of employees and employees on probation and the performance of employment agreement between you and PTT such as the issuance of employee card, the inspection of work entry hours, the management of annual leave, business leave or sick leave, etc.;

    (5)  The secondment of employee, the transfer, assignment or the appointing or performing duties as a director in any subsidiary, group company and associated company, including the granting and/or obtaining proxy from PTT and/or group companies for the meeting of shareholders of the companies in PTT Group, the coordination with government authorities, vendors, customers or relating organizations for the business operation of any subsidiary, group company and associated company, including the relevant proceedings in order to fulfil the aforesaid purposes;

    (6)  The training, the convening of operational seminar, academic seminar, academic conference, the convening of knowledge and work experience sharing event for supporting the business operation and policies of PTT Group, the issuance of relevant knowledge certificates necessary for the business operation of PTT Group, the accumulation of certificates of the employees who passed training course to prepare for the internal and external audit, including the proceedings as requested by laws and the review of relevant training documents and licenses required for the operation such as safety training certification, etc. including the preparation of such training records;

    (7)  The management concerning your health, occupation and safety, the procuring of annual health check both for the general heath check and occupational health check (health check according to risk factors), the provision of health insurance, fitness to work evaluation, health surveillance and health promotion, including to use as data for the reporting, investigation, analysis of causes or developing preventive health management and the determination of measures for the correction and prevention of the relevant incidents occurred;

    (8)  The consideration of qualifications for operation in specific area, offshore operation, including the request for approval or permission to perform duties or other operations such as platform operators at PTT Riser Platform and Erawan Riser Platform (PRP-ERP), etc.;

    (9)  Risk management and internal audit in the organization, audit supervision including internal audit of the internal audit office, good governance and organization internal management, the audit on any proceeding which may contrary to the regulations of the organization including the audit and management concerning relevant complaints resulting from the performing of works under employment agreement as well as the inquiry or investigation or any other legal proceeding and the audit on PTT’s operation by the external auditor; 

    (10)  For the necessity for the performance of relevant agreements that PTT is a service provider such as the provision of F&A, SSC and COE Finance services between PTT and the venders;

    (11)  For the proceedings in accordance with relevant processes and procedures in relation to the termination of employment such as resignation, dismissal of employment, retirement, early retirement, the resignation under organization mutual separation program and the reporting to relevant authorities;

    (12)  For the proceedings in accordance with relevant internal processes and procedures of PTT such as the request for approval, the request for disbursement and the request to use welfare benefits;

    (13)  The establishment or the using of relevant systems in relation to the operation including all electronic systems which PTT provides for the employees, for using as data for the determination of rights, roles and duties for an access to data, the reporting of data and the receiving of report in the reporting system according to relevant operation procedures;

    (14)  The relevant proceedings in relation to the procurement and management of commercial supplies and goods in accordance with the relevant laws, regulations, rules, notifications and practices such as the appointing of committee for relevant proceedings in relation to the supply, the preparation of invitation announcement page or letter of invitation to bid, the preparation of central list, the preparation of summary result of consideration, the preparation of contract or agreement and the preparation of other documents relating to the entire procurement process including the management of contract or agreement, the acceptance, the management of commercial supplies and goods, and the issuance of work acceptance certificate.

    (15)  The Applying for relevant projects or special activities convened by PTT for the employees on probation or employees such as Suk Jai Dee Project and for the interest in the operation of such project;

    (16)  Management of the data of name list of the employees responsible for the project and the members of Productivity Improvement Circle Project (PIC Project) in respect of the coordination and the provision of consultation so as to enhance knowledge and understanding for the improvement, the preparation of records of results of PIC Project, the request for personal data for acting as the representative of Thailand for the traveling to attend exhibitions of international standard quality including other work coordination for the success of the project.

For maintaining security in building area or premises of PTT and the evaluation of security risks including the communication for the issuance of access card(s) to work in the premises of PTT, the exchange of cards for building entry and exit, the requesting for car sticker, the recording of information on the entry and exit of PTT’s premises, and the recording of videos in the buildings or offices of PTT or PTT’s branches by closed-circuit television (CCTV).

For using in public relations activities in relation to the organization such as the public relations of relevant news, information and contents regarding PTT for employees in the organization, the public relations of photos of the activities held, the training whether it be the participation of activities in the area or the participation in form of online activities, whereby PTT may record the photos, video and/or voice of the participants and event atmosphere pictures for the preparation of media including the public relations of relevant news, information and content regarding PTT through relevant channels such as PTT’s website, annual report, online media and mass media.

        In some cases, we may collect, use and disclose personal data of the person in the family or other person of reference that our employees or employees on probation provided for us. In this respect, PTT shall collect, use and disclose personal data of those people under relevant lawful basis for the following purposes:

        PTT would like to inform you that for the processing of personal data of the employees on probation, the employees, the person in the family of the employees on probation and the employees including the data of the person of reference that our employees and employees on probation provided for us, we rely on relevant lawful basis as specified herein without relying on the consent; however, there might be the processing of personal data in certain cases that we could not rely on these lawful basis such as the cases required by laws to obtain consent from the owner of personal data for the processing of sensitive personal data, etc. For such cases, PTT shall request for your express consent (please read our letter requesting for consent in addition to this document) and in case that you are our employee or employee on probation and have provided personal data of the person in the family or the person of reference for us, you shall be responsible to inform those people of this Personal Data Privacy Notice and/or proceed to obtain consent (if necessary).


        In case that the aforementioned personal data collected by PTT is the information necessary for PTT’s performance of agreements or the compliance with relevant governing laws, if you refuse to provide such necessary personal data, PTT may not be able to enter into employment agreement with you or may not be able to administer and manage the agreements in accordance with the employment purposes, or this may affect the receiving of welfare and benefits or the provision of facilitations to you.


2.    Personal Data which shall be collected

        In general, PTT shall collect your personal data by directly requesting the data from you, for instance by having you fill in the forms determined by PTT, or inquiring data from you, or requesting you to submit documents containing your personal data to PTT; nonetheless, there may be some circumstances that PTT collets your personal data from other sources in order to fulfil the aforesaid purposes such as:

        •    The person of reference or the family member that you specified in the work application form of PTT or the data that you have provided to PTT thereafter;

        •    Medical centers after you have medical check or receive medical treatment;

        •    Government authorities or other public sources of information such as searchable data on the internet, e-Government Procurement System of the Comptroller General’s Department;

        •    Insurance companies or insurance brokerage and advisory companies;

        •    Provident funds, cremation welfare funds and savings cooperatives.

        In this regard, the personal data collected by PTT are as follows:


2.1    General personal data

        (1)    Identity data such as first name, last name, identification card number, passport number, date of birth, place of birth, gender, age, signature, photo, video and/or voice records, photo from CCTV, nationality and driving license, PTT’s defensive driving license, etc.;

        (2)    Contact data such as address, a copy of house registration, phone number, email, geolocation, LINE ID, data of the contact person in case of emergency;

        (3)    Family status data such as marriage status and number of children;

        (4)    Data for the provision of insurance such as health and life insurance, etc.;

        (5)    Financial data such as bank account number, salary, monetary bonus and financial status;

        (6)    Travel data and expenses in relation to the work operation such as details of expenses for travelling to perform onshore and offshore operation, shift allowance, overtime pay, shift premium, hardship allowance, home rental fees, accommodation fees, risk area allowance, allowance, advance payment, etc. including data used for supporting the disbursement of relevant welfare and benefits;

        (7)    Communication data with PTT such as photo and voice recording upon the communication with PTT;

        (8)    Data on the participation of relevant activities and production of public relations media including the registration, image capture, video and/or voice records, live recording or recording via other multimedia, data of the interest and expectation on event participation;

        (9)    Data concerning your employment and works such as employee ID, rank, position, level, evaluation result, length of experience in the rank, level, department or in PTT, year of retirement, records of annual performance evaluation result, records on position, competency assessment result, suitability evaluation result, competency analysis result, success profile evaluation and analysis result, personnel development method, data of work permit or professional license, working hours, the department positioned in, records of leave, work profile, salary, monetary bonus, address of the workplace, telephone number, email, position, name of the supervisor and cause of termination;

        (10)    Data concerning education, special abilities and expertise such as data of the scores and test results, educational degree, educational profile, training records, records as the lecturer and the teaching topics;

        (11)    Data concerning the utilization of relevant information systems of PTT, website browsing information such as Coach, ESS, LMS, TMS, SAP and E-library system, website browsing history, IP address information, information regarding the utilization of application, etc.;

        (12)    Identity data of the person in the family (father, mother, spouse, adopted child, sibling with the same parent in common or with the father or the mother in common) such as first name, last name, identification card number, passport number, date of birth, place of birth, gender, age, signature, photo, nationality, work profile, etc.;

        (13)    Data of personal specific details such as shirt size, chest size, weight, height, information of the royal decorations, tax deduction information, records of military conscription, e-signature, signature;

        (14)    Membership data of the clubs of PTT;

        (15)    Data of directorship in relevant committees;

        (16)    Data on the lodge of complaint, investigation, inquiry and punishment including the allegation of the commission of violation;

        (17)    Data of name titles such as royal titles, titles of honor, governmental positions or academic titles, etc.;

        (18)    Data of life insurance and provident fund beneficiary;

        (19)    Data concerning cars such as registration plate number, brand, model, car registration book, etc.;

        (20)    Data on the possession of PTT’s assets or data of assets that PTT supplied for operation such as car, computer, telecommunication equipment, etc.;

        (21)    Data of the status of being bankrupt;

        (22)    Data on the relevant forms such as Form RorPorPhor.1;

        (23)    Data regarding opinions such as the satisfactory on the participation of activities, the acknowledgement on PTT’s operation, etc.;

        (24)    Driving behavior while using PTT’s car.


2.2    Sensitive personal data

        In general, PTT has no intention to collect and use religious and blood type data specified in your identification card for any specific purpose. In the event that you provided PTT the copy of your identification card, it is requested that you conceal such data. If you did not conceal such data, it shall be deemed that you authorized PTT to conceal those data and such document with concealed data shall be deemed valid and legally enforceable in all respects. In case that PTT is unable to conceal those data due to some technical limitation, PTT shall collect and use such data as a part of your identification documents only. 


        However, if it is necessary for PTT to collect sensitive personal data for any specific purpose that PTT could not rely on lawful basis for the Processing, PTT shall request for your prior express consent. In this regard, PTT may process the following sensitive personal data:

        (1)    Health data such as underlying disease, blood type, occupational health check report, family health information, dental data, health check report, data of laboratory test result, history of illness and treatment, data on the use of medicine for specific symptom;

        (2)    Data regarding disability;

        (3)    Religious data;

        (4)    Racial data;

        (5)    Criminal record data;

        (6)    Narcotic test result data;

        (7)    Biometric data such as face recognition, fingerprint, voice recognition and genetic sequence data;

        (8)    Data of labour union membership status;

        (9)    Data of the status as incompetent or quasi-incompetent person;

        (10)    Data of food allergy.


3.    Period for retention of personal data

        PTT shall retain your personal data for the period necessary for the purposes of the collection, use or disclosure of personal data set out in this Privacy Notice in accordance with the period that you still receive benefits and welfare from PTT and the personal data shall be further retained for the period necessary for the compliance with laws or the statutory prescription period, or for the establishment, compliance, exercise or defense of legal claim and relevant proceedings, or for other reasons pursuant to the internal policies and rules in the organization of PTT.


4.    Disclosure of personal data

        In order to carry out the proceedings for the purposes set out in this Privacy Notice, PTT may disclose your personal data to the third party as follows:

        4.1    Companies in PTT Group in order to achieve the aforesaid purposes;

        4.2    The government authorities, regulatory authorities, state enterprises, state authorities, public organizations, independent organizations established pursuant to the laws or other authorities as prescribed by laws including the officers which exercise powers or perform duties according to the laws such as court, police, Revenue Department, the Office of Securities and Exchange Commission, Anti-money Laundering Office, Department of Labour Skill Development, Welfare and Labour Protection Department, Energy Business Department, Ministry of Natural Resources and Environment, Ministry of Transport, Ministry of Energy, Office of the Ombudsman, House of Representatives Committee, House of Senate Committee, Department of Legal Execution, Office of the Attorney General, State Audit Office of Thailand, the Office of National Anti-Corruption Commission, National Science and Technology Development Agency, etc.;

        4.3    Authorities, organizations, or the person relating to the exercise of right of claim, the commencing of legal proceeding, the objection to the complaint or the allegation, the defending of the case of PTT such as the parties of the case, witnesses, etc.;

        4.4    Agents, contractors/sub-contractors and/or service providers for any operation provided for PTT, auditors, independent internal auditors, lawyers, legal and tax advisors, actuaries, any advisor, providers of passenger or parcel transportation service by air, land or sea, publication and public relations media producers, activity organizers, training institutes, training companies, organizer companies including the lecturers both in the country and the foreign counties, etc.;

        4.5    Business partner companies, vendors, financial institutions and other necessary person so that PTT could operate business and make investment of various types or the provision of services to the employees or any other proceeding pursuant the purposes so specified;

        4.6    Insurers or insurance brokerage and advisory companies for any operation of PTT such as life insurance, health insurance, asset insurance, etc.;

        4.7    The third party according to your consent or the terms of agreements or the provisions of the laws, as the case may be;

        4.8    The transferee who received the assignment of any right, duty and benefit from PTT as a result of the restructuring of PTT pursuant to the employment agreement between you and PTT including the person assigned by such transferee to proceed on its behalf such as the case of the organization restructuring, merger or acquisition, employee transfer, etc.;

        4.9    Embassies of the relevant countries for sending employees to perform works and further their study pursuant to PTT scholar employee program including the universities in foreign countries;

        4.10    e-Government Procurement System of the Comptroller General’s Department;

        4.11    Shareholders and debenture holders of PTT;

        4.12    Mass media on the purposes relating to organizational public relations activities;

        4.13    Ordinary people on the purposes relating to organizational public relations activities.

        4.14    Hospital or clinic.


5.    The submission or transfer of personal data to foreign countries

        PTT may be required to send to transfer personal data to foreign countries, which may have standards of personal data protection higher or lower than those of Thailand because PTT has companies in the group which are located offshore. In addition, there are business operation or the entering into relevant transactions with companies in foreign countries; therefore, in some cases for the performing of works under employment agreement between PTT and you, it is necessary for us to disclose personal data of our employees or employees on probation to those companies in support of our normal business operation, for instance, for the coordination, negotiation and execution of business agreement or for sending employees on secondment, the transfer, the assignment, the participation as lecturer or attending training in oversea institutes, or in support of the appointing or acting as a director of the companies in the group, etc. In addition, we may be required to disclose your personal data including personal data of the person in the family of the employees or the employees on probation for the performance of agreement between PTT and other person or juristic person for the management concerning your rights and benefits or other benefits or for the prevention or suppression of danger to your life, body or health or these of the other person in case that you could not provide consent or the other cases as prescribed by laws.


        Furthermore, PTT may store employee’s data on computer server or in the cloud of offshore service providers and there might be a processing of data by using programs or applications of the offshore service providers.


        In this regard, for the submission or transfer of your data to foreign countries in whatsoever case, PTT shall comply with the Personal Data Protection Act B.E 2562 (2019).


6.    Your rights as the owner of personal data

        As the owner of personal data, you have the rights as prescribed in the Personal Data Protection Act B.E 2562 (2019). In this respect, you can exercise your relevant rights through the channels specified by PTT in Clause 8 or through PTT website, whereby you will be entitled to exercise the rights when the laws concerning personal data protection are applied to PTT. The relevant rights having details as follows:


6.1    Right to withdraw consent

        You shall have the right to withdraw the consent for the processing of your personal data that has already given to PTT unless such withdrawal of consent is restricted by laws or by the agreement that provides you the benefits. 

        Such withdrawal of consent shall not affect the processing of personal data legally conducted according to your prior consent.


6.2    Right to access to personal data

        You have the right to request for an access to and the request for the copy of your personal data under control of PTT, including to request PTT to disclose the acquisition of such data that you have not given consent to PTT.


6.3    Right to request for the submission or the transfer of personal data 

        You have the right to request PTT to transfer your personal data that you have given to PTT as prescribed by laws.


6.4    Right to object the collection, use or disclosure of personal data 

        You have the right to object the processing of data relating to you in respect of the collection, use or disclosure of your personal data as prescribed by laws.


6.5    Right to request for the erasure of personal data 

        You have the right to request PTT to delete your personal data as prescribed by laws. Nevertheless, PTT may store your personal data using electronic system pursuant to which some systems may be unable to delete the data, and for such case, PTT shall destroy or cause such data to be unable to identify your identity.


6.6    Right to request the restriction of the use of personal data 

        You have the right to request PTT to restrict the use of your personal data as prescribed by laws. Nevertheless, PTT may store your personal data using electronic system pursuant to which some systems may be unable to delete the data, and for such case, PTT shall destroy or cause such data to be unable to identify your identity.


6.7    Right to request for the rectification of personal data 

        If you found that the data controlled by PTT is incorrect or you have changed your personal data, you have the right to request PTT to correct your personal data so that such personal data be accurate, current, complete and not causing misunderstanding.


6.8    Right to lodge a complaint
